Terms and Conditions
This website is owned and operated by Qualimax Ltd trading as Living Culture. In these terms and conditions "Living Culture", "we", "our" and "us" means Qualimax Ltd, "you" refers to you the customer.
"Dollar" constitutes New Zealand dollars only. These terms and conditions together with your order constitute the entire contract between Living Culture and the customer. No other external terms and conditions are applicable to this website and business. Terms and conditions cannot be varied without prior approval from both parties in writing.
Acceptance of terms and conditions
The terms and conditions are the terms on which Living Culture offers you access to the services of our website. By registering as a member with us, or purchasing products from us, you are accepting these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the services. By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen years old.
New Zealand sales only
We only sell and ship Products within New Zealand. We do not make deliveries outside of New Zealand.
Payment methods and processing times
We currently accept payments using credit card facilities or bank deposit only.
Payments will not be processed until all applicable information has been received by Living Culture. Payments are not cleared on weekends or public holidays, please ensure sufficient funds are available on credit cards for payment to be processed on the next business day.
If your payment is not received within 7 days from the date that you receive your order confirmation, Living Culture reserves the right to cancel the transaction.
Living Culture also reserves the right to change prices for products displayed on livingculture.co.nz at any time without notification.
Delivery
Living Culture always aims to dispatch your item as soon as possible, it may however take up to 10 working days from date of payment for your item to be dispatched. Please note items will not be dispatched until payment has been received in full. Estimated delivery times will be displayed at the time of checkout.
Living Culture makes every effort to deliver your product according to the estimated delivery times provided at checkout, however bears no responsibility for delays caused by courier companies. All estimated delivery times are in business days and exclude weekends and/or public holidays.
For deliveries made by Living Culture, please be aware that our standard delivery service only includes one delivery person and delivers to your front door. Some of our products may be large and heavy, so it would be helpful if someone could be available to assist with unloading. If no one will be present to help, we offer the option of adding an extra delivery person for an additional fee of $50. If you have not already made arrangements, our customer service team will contact you to discuss your delivery options when your item is ready for delivery.
Click & Collect / Contactless Collection
Customers must check their order and the condition of the goods before taking the products off site. By taking the products away from the collection site, the customer is deemed to have checked and be satisfied with the condition of the products. Living Culture is not liable for any damage found on the products after they have been transported away from the collection site*.
(*Living Culture will take responsibility for missing parts, accessories or products that cannot be assembled due to a manufacturing error).
Preorder Terms & Conditions
By placing a preorder, you agree to the following terms:
- All preorder items require a 50% non-refundable deposit at the time of ordering.
- The remaining 50% will be charged automatically on or shortly before the estimated shipping date, as stated on the product page.
- Shipping timelines vary by product. The estimated shipping date is provided on each product page and may be subject to change.
- If there are significant delays, we will notify you as soon as possible.
- Cancellations are not accepted after the deposit has been paid, unless otherwise agreed.
Store Credit
Any credit awarded to the customer may only be used towards the payment of products listed on our website. Credit may only be used in accordance with the terms and conditions listed on the website. Any credit awarded is non-redeemable for cash.
If the product cannot be repaired or exchanged by the same or another item with at least the same specifications, then a full refund (including shipping) will be provided. The item(s) must be returned to us with all internal and external packaging, accessories, swing tags, labels and manuals. The item(s) must be complete and intact under the warranty provisions. Upon return Living Culture or the local distributor/manufacturer will repair or replace damaged or faulty goods. If the product cannot be repaired or exchanged for a same or similar item, a full refund (including shipping) will be provided.

Credit Card Fraud
Whilst Living Culture employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Living Culture will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorized manner.

Offer Details:
Customers who make a qualifying purchase of full-priced items during the promotion period will receive a gift card as follows:
- Spend $1,000 or more → receive a $100 Gift Card
- Spend $3,000 or more → receive a $400 Gift Card
- Spend $6,000 or more → receive a $1,000 Gift Card
Please Note: Only the purchase amount of full-priced items contributes toward the minimum spend thresholds. The purchase of discounted, clearance, or special-priced items is strictly excluded from this gift card promotion.
Terms of Use:
- Gift cards are valid for 3 years from the date of issue.
- Gift cards can only be used for future purchases and cannot be redeemed for cash.
- Gift cards are non-transferable and cannot be exchanged for cash, credit, or other alternatives.
- Only one gift card reward applies per qualifying purchase transaction.
- If a qualifying purchase is returned or refunded, the value of the gift card will be deducted from any refund issued.
- This offer cannot be used in conjunction with other promotions unless otherwise stated.
General:
- Living Culture reserves the right to modify or withdraw this promotion at any time without prior notice.
- Standard product terms, warranty, and return policies apply to all purchases.
These terms and conditions apply to all "Gift with Purchase" promotional events (including bonus gift cards and physical promotional items) offered by Living Culture, unless otherwise specified in the specific promotion details.
1. Qualifying Purchases
- To be eligible for a promotional gift or bonus gift card, customers must meet the specified minimum spend threshold in a single transaction.
- Full-Priced Items Only: Only the purchase of full-priced items contributes toward the minimum spend threshold. Discounted, sale, clearance, or special-priced items, as well as shipping fees, are strictly excluded from the qualifying amount.
- The minimum spend requirement is calculated after any applicable discounts or store credits have been applied.
2. Promotional Gifts (Physical Items & Gift Cards)
- Physical Gifts: All physical promotional gifts are subject to availability and are offered strictly while stocks last. Living Culture reserves the right to substitute a gift of equal or greater value if the original item becomes unavailable.
- Bonus Gift Cards: Promotional gift cards will be issued subject to standard Living Culture Gift Card terms. They are valid for 3 years from the date of issue and can be used on future purchases (including sale items).
- Gifts and bonus gift cards are non-transferable, non-exchangeable, and cannot be redeemed for cash or credit.
- Unless otherwise stated, only one promotional gift or bonus gift card will be awarded per qualifying transaction, per customer.
3. Returns and Refunds
If you wish to return a purchased item that qualified you for a promotional gift or bonus gift card, the following conditions apply:
- If you received a physical gift: The unused promotional gift must be returned in its original condition along with the qualifying item. If the gift is not returned, or is returned used/damaged, the full retail value of the gift will be deducted from your refund.
- If you received a bonus gift card: Living Culture will either cancel the issued gift card or, if the gift card has already been partially or fully redeemed, deduct the used value of the gift card from your refund amount.
4. General
- This offer cannot be used in conjunction with any other promotional offers, discount codes, or financing options unless specifically stated.
- Living Culture reserves the right to amend, suspend, or terminate the promotion and these Terms and Conditions at any time without prior notice.
